Types of Personal Injury Claims
Personal injury claims can be vehicle accidents (car, truck, bus, private or public) which is the area in which most personal injury actions arise. Others include claims based on incidents that are premises related, where the claim comes from a slip and fall, or some other incident that is tied to someone’s ownership, possession or rental/leasing of land. Most of these claims are based in a claim of negligence. They can also include dog bites, legal or medical malpractice, defamation (slander or libel), claimed exposure to toxic chemicals, claimed assault or battery, etc.
The Resolution Process
Personal injury claims are often mediated which allows for settlement of the claims on terms and conditions that are agreeable to all involved. If the parties cannot agree, then arbitration, whether binding or non-binding is possible.
How Breitman Resolutions Can Help
Most claims are ready for the discussion and mediation process by the time the call comes in to set a hearing. To make sure the hearing will have the greatest chance for success, a briefing process and timetable will be set to make sure that information is exchanged between all parties. A Pre-Hearing Telephone Conference may be set to get an update on status, to resolve any problems or anticipated issues before the hearing and to make sure the case is ready for mediation with the sharing of information that is needed to assist those involved in seeking resolution of the claim. All briefs are read, so that the hearing can start on time and move the matter along to resolution.
